My Claim Was Denied. What Can I Do?

Insurance companies do not prosper by freely paying the full value of property damage claims. They use a number of tactics to limit and deny claims, including:

  • Claiming the damage was due to a factor other than a covered event
  • Arguing the damage is less than what you claim

Remember, you do not have to accept their offer if you do not believe it is fair. An experienced attorney can conduct a thorough investigation into your policy, the covered event and the damage to determine the true value of your claim. Talk with a knowledgeable lawyer before signing anything.

Should I Repair My Property Immediately?

Generally, it is wise to wait until an insurance adjuster has inspected your property before making repairs to it. If repairs are necessary for safety and preventing further damage, however, then you may want to make them. In any event, make sure you save receipts of all bills related to the repairs and take pictures of the damage.

What If The Insurance Company Delays?

Under Texas law, insurance companies must respond within 15 days after receiving your claim in writing. If they agree to pay your claim, they must send payment within five days. If your insurance company is delaying your claim, you may be entitled to damages. An experienced lawyer can help you determine your rights and the insurance company’s obligations under Texas law.
