Helping Employees With Age Discrimination Claims
The federal Age Discrimination in Employment Act (ADEA) is designed to protect workers who are 40 years of age or older from discriminatory practices based on age. If you believe that an employer has taken adverse action against you because of your age, it is important to seek legal representation as soon as possible.
At the Law Office of Jose G. Gonzalez, our attorneys have more than 35 years of combined experience handling discrimination claims for workers throughout the Rio Grande Valley and South Texas. To schedule an initial consultation, call 956-731-4324.
When Is Age Discrimination Prohibited?
The ADEA protects workers in a variety of different areas. It is illegal to discriminate against a person based on their age when it comes to:
- Hiring
- Financial compensation
- Promotions
- Job assignments
- Training
- Layoffs
- Severance benefits
It is important to note that the ADEA only applies to businesses with 20 or more employees, including private and public-sector employers. Furthermore, job advertisements may generally not require age limitations. However, if an employer can show that age is a “bona fide occupational qualification”, an exception may be made.
In addition to outlawing age-based discrimination, the ADEA also provides protection for employees who oppose discriminatory practices or pursue legal action against an employer.
